PARTITION BY METES AND BOUNDS

Write a short note on Partition by Metes and Bounds.

According to Mitakshara law school, partition is a division of the joint family property i.e. coparcenary property and according to this school individual property i.e. separate property is not subject to partition. It is a process by which coparceners severe his relation with the joint family and is no more a coparcener.

In Mitakshara law school, partition means two things:-
• Severance of status or interest of each coparcener
• Actual division of property in accordance with the shares so specified, known as partition by metes and bounds.

So, metes and bounds are boundary lines of land. This basically means a drawing of a boundary lines and the physical act of dividing the property.

But, in Dayabhaga School, partition means only division of property by meet and bounds.
