IS WORLD BANK A GOVERNMENT AGENCY UNDER ARTICLE 12 OF INDIAN CONSTITUTION?
โข Honโble Delhi High Court has stated that World Bank is not a government agency for the purpose of Article 12 of Indian Constitution.
โข Justice Vipin Sanghi and Justice Jasmeet Singh of Honโble Delhi High Court stated that according to Article 12 of Indian Constitution, to be a government agency, an institution must be under the actual and pervasive control of the Government of India and there must be a relation of Principal and Agent between the Government Agency and Government of India but World Bank as an International Institution is not under the control of Government of India and not bound by the directions issued by the Government of India and moreover, there is no relationship of Principal and Agent between World Bank and Government of India.
